In surveying the space, we're seeing another acronym now making rounds, rapidly appearing in legal demand letters targeted at brands: CIPA.

The California Invasion of Privacy Act (CIPA) is a decades-old privacy law that’s increasingly being cited in lawsuits involving modern ecommerce websites. Plaintiffs have argued that technologies such as tracking pixels, analytics tools, session replay software, chat widgets, and other third-party scripts — all common now more than ever — may collect or transmit user information before consent. Courts are still shaping how this will all apply, but the number of lawsuits has continued to grow.

This upward trend is because every new marketing app promises better attribution, every new conversion tool adds another script, and every agency installs another pixel.

Yet internally, very few teams know:

  • What scripts are running

  • When they load

  • What data they’re collecting

  • Whether they’re firing before consent

  • Whether they have the records to demonstrate proper consent if a claim is ever made

And that uncertainty can become expensive.
